Guide to Sentencing


To determine the appropriate sentence use the flow chart below (but be sure to consult the notes as well). Remember YOU CAN get probation (technically a 1 day split) on a first D violent offense and in most first non-violent C's. Remember also that sentences with hyphens (like 2.33-7) are indeterminate sentences and a determining exactly what a client will serve is difficult- remember please, that the salient features of any indeterminate sentence are: board date, CR date and max date, corresponding to 1/3's of the maximum. Also remember that you should always assume that in any sex case the client will be held to a CR date or beyond.
